DMCA Copyright Policy

This DMCA Copyright Policy ("Policy") describes how AIZeryn LLC responds to allegations of copyright infringement in accordance with the Digital Millennium Copyright Act of 1998, 17 U.S.C. § 512 (the "DMCA"). If you believe that your copyrighted work has been copied, used, or made available through our Services in a way that constitutes copyright infringement, please follow the procedures outlined below.

3. Notification of Claimed Infringement (Takedown Notice)

Required elements:

1. physical or electronic signature of the copyright owner or authorized person;
2. identification of the copyrighted work(s) claimed to have been infringed;
3. identification of the infringing material with information reasonably sufficient to permit AIZeryn LLC to locate it (e.g., specific URLs, screenshots, usernames, or detailed descriptions);
4. contact information including name, mailing address, telephone number, and email;
5. a good faith belief statement that use is not authorized by the copyright owner, its agent, or the law;
6. a statement under penalty of perjury that the information is accurate and that you are authorized to act on behalf of the owner.

Send complete notices to the Designated Agent via email or postal mail. Incomplete notices may not be acted upon.

4. Counter-Notification Procedures

Required elements:

1. your physical or electronic signature;
2. identification of the removed material and where it appeared before removal;
3. a statement under penalty of perjury of good faith belief that the material was removed by mistake or misidentification;
4. your name, mailing address, and telephone number;
5. consent to jurisdiction of the Federal District Court for your judicial district (or, if outside the U.S., the Middle District of Florida) and acceptance of service of process from the original complainant.

Process: AIZeryn LLC will promptly provide the complaining party a copy, inform them it will restore within ten (10) to fourteen (14) business days, and restore unless the Designated Agent first receives notice that an action has been filed seeking a court order.

5. Repeat Infringer Policy

AIZeryn LLC has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users deemed to be repeat infringers. A "repeat infringer" is a user subject to more than two (2) valid DMCA takedown notices. Consequences may include warnings, temporary suspension, permanent termination, or other action. We reserve the right to terminate any user's account at any time, with or without notice.

6. AI-Generated Content

6.1 Nature of AI Output

Our Services may generate text, images, audio, or other content using artificial intelligence and machine learning technologies ("AI-Generated Content"). Users acknowledge and agree that:

• AI-Generated Content is created algorithmically and may inadvertently resemble existing copyrighted works without intent to infringe;
• AIZeryn LLC does not manually review all AI-Generated Content before it is displayed or delivered to users;
• AIZeryn LLC will respond to valid DMCA notices regarding AI-Generated Content in accordance with this Policy.

6.2 User Responsibility

Users are solely responsible for reviewing AI-Generated Content before using, sharing, or publishing it; ensuring their use does not infringe third-party rights; and obtaining necessary licenses, permissions, or clearances.

6.3 No Guarantee of Originality

AIZeryn LLC makes no representation or warranty that AI-Generated Content is original, non-infringing, or suitable for any particular purpose.

7. User-Generated Content

7.1 User Submissions

By submitting content, you represent and warrant that you own or have the necessary rights; your content does not infringe, misappropriate, or violate third-party rights; and it complies with all applicable laws and our Terms of Use.

7.2 No Monitoring Obligation

AIZeryn LLC is not obligated to monitor User-Generated Content but reserves the right to remove or disable access to content we believe in good faith infringes third-party copyright.

8. Misrepresentations and Bad Faith Claims

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents infringement may be liable for damages, including costs and attorneys' fees. Please ensure good faith belief in your claim and consider fair use before submitting a takedown notice.

9. Modifications to This Policy

AIZeryn LLC reserves the right to modify this Policy at any time; changes effective immediately upon posting; continued use constitutes acceptance.
